4 Australian Visa Application Process

4.1 For Foreign Workers Coming to Australia (Skilled Worker)

This visa is part of the “Australian General Skilled Migration” program, a points-based system that evaluates applicants according to Australia’s skilled immigration criteria (Points Test). Candidates are assessed based on their education, professional qualifications, work experience, and English language skills (IELTS or PTE) to meet the requirements of the Australian Department of Immigration and calculate the Points Test score for each application.

The conditions to submit an Expression of Interest (EOI) for this visa category include:

  • The occupation must be on the Skilled Occupation List (SOL).
  • The applicant must pass a skills and work experience assessment.
  • The applicant must be under 50 years of age.
  • The applicant must achieve a minimum score of 65 points (varies by occupation).
  • English language proficiency: IELTS score of at least 6.5 or PTE score of at least 65.

The Australian government allocates a certain number of visas each year for priority occupations and gives special consideration to candidates with skills in occupations that are in shortage in Australia.

After submitting a complete application to the Australian Department of Immigration, the criteria will be reviewed to determine the appropriate score. Criteria that meet the requirements will be awarded points, while criteria that do not meet the standards will not be considered. The total score of the application will determine the order of processing, with higher-scoring candidates given priority on the waiting list.

4.2 Family Sponsorship Visa

The family sponsorship visa category is a popular option for helping families reunite in Australia. With this type of visa, your entire family can settle permanently and may have the opportunity to become Australian citizens if they meet the citizenship requirements.

Parent Visa

Other Family Visa

As per the latest update from the Australian Department of Immigration (2024), an English language certificate is now mandatory for all visa types. A higher English score will contribute additional points towards your immigration points. Additional conditions may apply based on specific government policies.

4.3 Business and Investment Immigration Visa (Subclass 188A)

The Subclass 188A visa is part of the Business Innovation and Investment (Provisional) Visa program. It is designed for entrepreneurs, major shareholders, and business owners who wish to expand their business and settle in Australia.

Eligibility for Subclass 188A Visa:

  • Age: Under 55 years (may be waived in certain cases).
  • SkillSelect Invitation: You must be invited to apply through the Australian SkillSelect system.
  • Points Requirement: Achieve a minimum of 65 points according to the Australian Government’s points system.
  • Business Experience: In the last 2 out of 4 years, applicants must meet the following criteria:
    • Minimum business revenue of AUD 500,000.
    • Total accumulated assets of at least AUD 800,000.

  • State or Territory Nomination: You must have a letter of nomination or endorsement from an Australian state or territory.

Benefits of Holding a Subclass 188A Visa:

  • Temporary Residency: This visa is valid for 4 years, with the opportunity to transition to permanent residency.
  • Pathway to Permanent Residency: If you fulfill the business and investment commitments outlined in the initial visa, you can apply for a permanent residency visa.
  • Visa Extension: If additional time is needed to complete business commitments, the visa can be extended for 2 years, allowing up to 6 years in total.
  • Free Education for Children: Your children can study for free from grades 1 to 12.
  • Work, Study, and Business: You are free to work, study, and conduct business in Australia during your visa period.

5. Conditions for Immigration to Australia
